THE FOLLOWING TERMS AND CONDITIONS GOVERN YOUR USE OF THIS WEBSITE AND YOUR MEMBERSHIP IN THE PENN STATE WOMEN’S VOLLEYBALL BOOSTER CLUB. PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE OR JOINING THE CLUB. BY USING THIS SITE OR BECOMING A MEMBER, YOU AGREE TO THESE TERMS IN THEIR ENTIRETY.
1. Applicability
These terms and conditions apply to your use of the Penn State Women’s Volleyball Booster Club website (the “Site”) and your membership in the Booster Club. These terms may be updated at any time without prior notice. The most recent version will always be posted on the Site. Your continued use of the Site or membership in the Club after any changes constitutes acceptance of the updated terms.
2. Online Account Access
- For certain features available through the Site, you are able to create a Penn State Women’s Volleyball Booster Club account (“User Account”). For self-enrollment, you must provide Account-specific information to authenticate yourself (i.e., Account owner name, address, email address, phone number, and password). We use reasonable precautions to protect the privacy of your User Account information.
- Your UserID, password, and User Account information are encrypted using an SSL connection and are not expected to be read in an intelligible form as they travel to the Website. You, however, are ultimately responsible for protecting your UserID, password, and User Account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies.
- You are required to take reasonable precautions to safeguard your UserID and password. You agree to never leave your computer unattended while logged into your User Account and to always exit by clicking on “Log Out.” You also agree to immediately notify the Club of any unauthorized use of your UserID, password and/or User Account, or any other breach of security by contacting us via our designated contact method.
- You are solely responsible for any activity that occurs with respect to your User Account and UserID. While we provide certain encryption technologies and use other reasonable precautions to protect your confidential information and provide suitable security, we do not and cannot guarantee or warrant that information transmitted through the Internet is secure, or that such transmissions are free from delay, error, interception, or interruption.
- By creating and using a User Account, you consent to receive electronic communications from the Club related to your account and Club activities. You may opt out of non-essential communications at any time by updating your account preferences or contacting us directly.
3. Site Use and Content
- All content on this Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, is the property of the Penn State Women’s Volleyball Booster Club or its content suppliers and is protected by United States and international copyright laws.
- You may view, download, and print pages from the Site solely for personal, non-commercial purposes related to your involvement with the Penn State Women’s Volleyball Booster Club. You may not otherwise use, modify, copy, print, display, reproduce, distribute, or publish any information from the Site without express, prior, written consent from the Club.
- The trademarks, logos, and service marks displayed on the Site are registered and unregistered marks of Penn State University, the Penn State Women’s Volleyball program, or the Penn State Women’s Volleyball Booster Club. Nothing contained on the Site should be construed as granting any license or right to use any trademark without the prior written permission of the trademark owner.
- You are prohibited from using any of the marks appearing on the Site without express, written consent from the trademark owner, except as permitted by applicable law.
4. Site Functionality
- This Site allows you to purchase products, memberships, make donations, and purchase event tickets associated with the Penn State Women’s Volleyball Booster Club. These transactions are governed by the terms outlined in this agreement and any additional terms specified during the purchase process.
- The Club reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.
5. Termination of User Account
- The Penn State Women’s Volleyball Booster Club reserves the right to terminate your User Account for any reason, including inactivity, at any time without prior notice. We may take this action if we believe you have violated these Terms, engaged in any illegal or improper conduct, or for any other reason we deem necessary.
- You have the right to terminate your User Account at any time by contacting the Club in writing at the address provided at the end of these Terms. Please note that certain membership benefits may cease upon account termination.
- Any termination of your User Account, whether initiated by you or the Club, will not affect any of your or the Club’s rights and obligations under these Terms that have arisen prior to the effective date of such termination. This includes, but is not limited to, any financial obligations, purchased merchandise, or event bookings.
- Upon termination, you will no longer have access to your User Account or any features requiring account login. However, you may still be able to access public areas of the Site.
- The Club is not liable for any loss or damage that may result from the termination of your User Account.
6. Payment Terms
- All prices for memberships, merchandise, event tickets, and donations are clearly displayed on the Site. These prices may differ from those offered through other channels or at in-person events. The Club reserves the right to change prices at any time without prior notice.
- When we offer promotions or special discounts, the specific terms of these offers will be provided separately. In case of any conflict between promotional terms and these general Terms, the promotional terms will take precedence.
- We make every effort to ensure the accuracy of pricing and product information on our Site. However, we reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders resulting from such mistakes.
- You are responsible for paying the full price stated at the time of your transaction, including any applicable: (i) Sales tax, use tax, or other related taxes (ii) Shipping and handling charges for physical merchandise
- Accepted payment methods include credit cards and debit cards. By making a payment, you represent and warrant that you have the legal right to use the chosen payment method and that you are not violating any applicable laws or regulations.
- All payments are processed securely. The Club does not store complete credit card information on our servers.
- Refunds or cancellations, if applicable, will be handled according to our separate Refund Policy [link to policy].
7. Memberships
- To become a member of the Booster Club, you must be at least 18 years old and provide accurate information when registering. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. See more details pertaining to our membership policy.
8. Dues and Donations
- Membership dues and any additional donations are non-refundable. Funds raised support the Penn State Women’s Volleyball program as determined by the Booster Club board.
9. Club Activities
- The Booster Club may organize events, provide insider information, and offer special merchandise to members. Participation in these activities is voluntary and may involve additional costs not covered by membership dues.
10. Conduct
- Members agree to conduct themselves in a manner that positively represents the Booster Club and Penn State Women’s Volleyball. Any behavior deemed detrimental to the Club may result in termination of membership without refund.
